Cancellation policy
Introduction
Consumers have a right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who concludes a legal transaction for purposes that can predominantly neither be attributed to their commercial nor their independent professional activity:
Right of withdrawal
You have the right to withdraw from this contract within 30 days without giving any reason.
The cancellation period is 30 days from the day on which you or a third party other than the carrier designated by you takes possession of the last item. The item must be unused and in the same condition in which you received it. Your item must be in its original packaging.
Your item must have the receipt or proof of purchase.
To exercise your right of withdrawal, you must inform us (Gíabo, Lerchenauerstraße 40, 80809 Munich, Germany, Tel.: 015906848886, Email: contact@giabo.de) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or email). You may use the attached model withdrawal form for this purpose, but this is not mandatory.
To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the cancellation period has expired.
Consequences of revocation
If you cancel this contract, we will refund all payments that we have received from you, less delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us promptly and in any event no later than fourteen days from the date on which you notify us of the cancellation of this contract. This deadline is met if you send the goods before the expiry of the fourteen-day period.
You shall bear the direct costs of returning the goods.
You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.
Exclusion or premature expiry of the right of withdrawal
The right of withdrawal does not apply to consumers who are not members of a member state of the European Union at the time the contract is concluded and whose sole residence and delivery address are outside the European Union at the time the contract is concluded.
General information
1) Please avoid damaging or contaminating the goods. Please return the goods to us in the original packaging with all accessories and packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please ensure that you use suitable packaging to adequately protect it from transport damage. 2) Please do not return the goods to us without a tracking number. 3) Please note that the above-mentioned points 1-2 are not a prerequisite for the effective exercise of the right of withdrawal.
Note on the exclusion of the right of withdrawal for personalized products
According to Section 312g Paragraph 2 No. 1 of the German Civil Code (BGB), there is no right of withdrawal for goods that are manufactured according to customer specifications or are clearly tailored to personal needs.
Since our personalized products are manufactured individually according to your specifications (e.g., engraving, design, size, or color choice), they are excluded from the right of withdrawal. Therefore, please check carefully before completing your order to ensure that all the specifications you have provided are correct.
